PAYMENT & CANCELLATION
Payment in full is due at time of booking. The Loyal Hound Inc. abides by a strict no refund or exchange policy in regards to training programs, sessions, or packages *that have been completed*. Client is solely responsible for contacting The Loyal Hound, LLC regarding the scheduling of any and all sessions upon booking of program or package, and no prorated refunds will be granted in the partial completion of a package or program. If a client cancels anytime BEFORE the start date of a training program, please note that 50% of the initial payment will be refunded. A client’s commitment to a program makes an opening unavailable, forcing us to turn down other dogs and humans who may need urgent help. We thank our clients for their understanding and consideration in this matter.
PHOTO/VIDEO RELEASE
I hereby assign and grant to The Loyal Hound the right and permission to create, use, reproduce, distribute, and publish any photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) of me and/or my dog(s) at any time during the training and/or boarding of my dog(s) by The Loyal Hound, and I hereby release The Loyal Hound from any and all liability resulting from such use, reproduction, distribution, and publication. I hereby authorize the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) without limitation at the discretion of The Loyal Hound and I specifically waive any right to any compensation I may have for any of the foregoing.
LIABILITY WIAVER/GENERAL POLICY:
THE LOYAL HOUND will endeavor to create a safe environment for the training and boarding care of the dog(s) identified above (the “Dog”), and to offer only sound, safe, and responsible training, care, and post-boarding training instructions. Owner agrees, however, that all animals may exhibit unpredictable behaviors and that THE LOYAL HOUND will not be liable for the actions of the Dog that are outside of the control of THE LOYAL HOUND. Owner agrees that the recommendation by THE LOYAL HOUND of any product or service is not a guarantee of performance or Owner’s satisfaction with that product or service. Owner understands that in the highly unlikely event that a dog dies in our care, the body will be transported to Wheat Ridge Animal Hospital to determine cause of death and for the client to retrieve. THE LOYAL HOUND agrees to indemnify and hold Owner harmless from and against any claims of injury, expense, costs, loss or damages caused by the gross negligence or willful misconduct of THE LOYAL HOUND while the Dog is in the sole custody, care and control of THE LOYAL HOUND. Owner acknowledges that THE LOYAL HOUND has no control over the Dog when the Dog is not in the exclusive custody, care and control of THE LOYAL HOUND, and Owner agrees to indemnify and hold THE LOYAL HOUND harmless from and against any and all claims of injury, expense, costs, loss or damages caused by the actions of the Dog when the Dog is not the sole custody, care and control of THE LOYAL HOUND. Owner acknowledges and agrees that owning any animal, including the Dog, has inherent risks, including but not limited to the risk of dog bites to Owner or others. Owner fully understands the tools and techniques that are used to train and modify the behavior of the Dog and agrees to the use, at the sole discretion of THE LOYAL HOUND. Of these tools and techniques which may include prong collar, bark collar, Remote training collar, pet convincer, and muzzles where necessary or appropriate.
STATEMENT OF OWNER COMPLIANCE & TRAINING GUARANTEE
Owner understands that there are many components that go into creating a healthy, emotionally sound, obedient, balanced dog. OWNER understands that a successful dog training program depends on a combination of learned skills on the part of both the OWNER and THE DOG. OWNER understands that THE DOG’s behavior is not static, that THE DOG will NOT continue to perform even trained behaviors without ongoing practice. Especially in cases involving any type of aggression, OWNER understands THE DOG is never considered “cured”, but rather the behavior modified, made manageable, and the risk mitigated. OWNER agrees to comply 100% with the following THE LOYAL HOUND LLC requirements for the life of THE DOG: implement the protocols and practices with THE DOG, which are demonstrated in transfer sessions. Make obedience a way of life for THE DOG. Practice ALL commands with THE DOG anywhere, everywhere, anytime. Although THE LOYAL HOUND LLC cannot guarantee, beyond any doubt, that THE DOG will respond to all commands at all times—this can only be guaranteed by the OWNER’s diligence with THE DOG—THE LOYAL HOUND LLC does guarantee that training will be completed to OWNER’S satisfaction, in accordance with the provisions of this Agreement. Further, if OWNER complies with the OWNER Performance requirements in this Agreement, THE DOG is healthy, and THE DOG forgets a command it was trained to do, THE LOYAL HOUND LLC will train THE DOG that forgotten command. THE LOYAL HOUND LLC trains THE DOG and OWNER how to properly respond to and operate the specified e-collar. OWNER agrees THE DOG’s behavior is ultimately OWNER’s responsibility. OWNER understands that transfer session(s) IDEALLY take place within ONE MONTH after the completion of a Board and Train Program. This ensures that newly learned behaviors, social skills, and commands translate successfully to the dog's home environment. Scheduling of transfer sessions are the OWNER'S responsibility.
Your dog will be staying at a working facility, playing with dogs, running in the grass and dirt, and there is the very likely possibility of a bump, bruise, or scratch here and there. We do everything in our power to maintain a high standard of safety and cleanliness, mitigating risk here at the facility, and wherever the dogs are in our care. However, as Owner, you acknowledge and understand that there are certain risks involved in pet training, boarding, and care. You release, indemnify, and agree to hold THE LOYAL HOUND harmless from any and all manner of damages, claims, loss, liabilities, costs or expenses, causes of actions or suits, whatsoever in law or equity, (including, without limitation, attorney’s fees and related costs) arising out of or related to the services provided by THE LOYAL HOUND.
ELECTRONIC SIGNATURE AGREEMENT
By typing your initials in the field below, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By typing your initials in the field below, you consent to be legally bound by this Agreement's terms and conditions. You also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and THE LOYAL HOUND. You also represent that you are authorized to enter into this Agreement for all persons who have ownership over said dog(s), and that such persons will be bound by the terms of this Agreement. You further agree that each use of your Esignature consititues your agreement to be bound by the terms and conditions of THE LOYAL HOUND Waiver of Liability and Training Release Form as they exist on the date of your Esignature.
